Thinstuff's offer of goods and services in its online shop at www.thinstuff.com/licensing constitutes a non-binding invitation by Thinstuff to its customers to make binding offers to purchase such goods and services. The customers may make such binding offers by placing orders in the online shop. A contract between the customers and Thinstuff is only concluded when Thinstuff accepts such an offer with a separate order confirmation. In case the customer does not complete the purchase within 14 days, Thinstuff reserves the right to cancel the contract and to delete the order. The customer agrees to receive invoices in electronic form. Prices stated on the website do not include statutory tax. The total costs of a contract, including statutory tax, will be shown in the online shop before the contract declaration is submitted.
All non-free Thinstuff products (except where explicitly stated) include 1 year basic support. This basic support includes email support with no guaranteed response time and no guaranteed solutions for a particular problem. For advanced support please contact Thinstuff directly.
The bought software can be updated (e.g. additional features, bugfixes,...) for one year within the same major version (only changes in the minor version, the part after the ".") for free. Updates to other major versions or editions can be bought according to the currently valid and published price list.
If the device on which the customer uses the software suffers impairment or harm to its hardware or software, or the data stored on such device is impaired, damaged or totally or partially deleted, due to or in connection with the customer downloading the software or using it, Thinstuff shall only be liable for such damage if it was guilty of wilful default or gross negligence and if the damage was directly or indirectly caused by the software and its permissible use by the customer. This disclaimer of liability shall not apply to any personal injury.
Thinstuff disclaims liability for any loss of profit and consequential damages resulting from the events listed in the previous sub-clause, to the extent permitted by law.
The warranty period is six months and begins with the conclusion of the contract.
If Thinstuff offers demo software or beta software, these are for preview and evaluation purposes only. Demo software is for testing purposes only. Beta software is in a testing state and may contain significant defects. Thinstuff disclaims liability for damage (other than personal injury) caused by software marked as demo software or beta software. This disclaimer of liability also applies to any loss of data. Thinstuff disclaims any warranty for demo software or beta software.
